Terms and Conditions

By commissioning a pet portrait from Charcoal Whiskers, you agree to the following terms and conditions. These ensure a smooth and transparent process for both the artist and the client. Please read them carefully before placing an order.

Commission Agreement for Charcoal Whiskers
Agreement Overview
This Agreement outlines the terms and conditions under which Charcoal Whiskers ("Artist") agrees to create a custom charcoal pet portrait ("Artwork") for the Client.
Commission Process
Artwork Specifications: The Client will provide a clear photo of their pet and specify the size and any additional features for the Artwork.
Approval Process: Preliminary sketches will be sent to the Client for approval. Minor revisions are included; however, major changes may incur additional fees.
Payment Terms
Deposit: A non-refundable deposit of 50% of the total price is required to begin work on the Artwork.
Final Payment: The remaining balance is due upon completion of the Artwork and before shipping.
Etsy Orders: Orders placed via Etsy must be paid in full at the time of purchase and are subject to Etsy’s terms and conditions.Completion and Delivery
Timeline: Standard completion time is between 2-3 weeks from receipt of the deposit and reference photo. This may vary based on workload and Artwork complexity.
Shipping: The Artwork will be securely packaged and shipped via Australia Post. Standard shipping costs are included, but express shipping is available at an additional cost.
Cancellation Policy
By Client: Cancellations within 48 hours of paying the deposit may be refunded in full. After 48 hours, the deposit is non-refundable.
By Artist: If the Artist must cancel the commission for any reason, the deposit will be fully refunded to the Client.
Copyright and Reproduction Rights
Artist's Rights: Charcoal Whiskers retains all rights to the completed Artwork, including the right to display it for promotional purposes.
Client's Rights: The Client has the right to display the Artwork in a private setting. Reproduction or commercial use is prohibited unless explicitly agreed upon in writing.
Alterations
Any alterations made to the Artwork by the Client after delivery are not the responsibility of Charcoal Whiskers.
Liability
Charcoal Whiskers is not liable for any damage to the Artwork due to improper handling or display by the Client.
Agreement Modifications
Any modifications to this Agreement must be made in writing and agreed upon by both parties.
Governing Law
This Agreement is governed by the laws of Victoria, Australia.
